Please read these Terms of Service (“Terms”) carefully before using MogulAim (“the Service”) operated by MogulAim (“us”, “we”, or “our”). By accessing or using the Service, you agree to be bound by these Terms.
MogulAim provides an AI-powered outbound sales automation platform for commercial real estate professionals. You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at support@mogulaim.com if you suspect unauthorized access.
MogulAim offers paid subscription plans billed on a monthly or annual basis. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to change pricing with 30 days’ notice. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
You are solely responsible for the content of emails sent through the Service and for ensuring your outreach complies with all applicable laws, including CAN-SPAM, CASL, GDPR, and any state or local equivalents. You must include a functioning unsubscribe mechanism in all commercial emails and honor opt-out requests promptly. MogulAim may suspend or terminate your account if we determine you are using the Service to send spam or violate email regulations.
The Service and its original content, features, and functionality are and will remain the exclusive property of MogulAim. Content you upload to the Service (contact data, campaigns, etc.) remains yours. You grant MogulAim a limited license to process your content solely for the purpose of providing the Service. We do not use your data to train AI models without your explicit consent.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of data as described in our Privacy Policy.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOGULAIM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
We may terminate or suspend your account immediately, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease. You may export your data at any time while your account is active.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.
We reserve the right to modify these Terms at any time. We will provide at least 14 days’ notice of material changes via email or in-app notification. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
